General rules
Licensing and enrollment duration
Each license is in the name of a single person (license holder), identified by name, and is not transferable from one person to another.
The courses can only be enjoyed individually by the license holder. Group use is prohibited.
Each course has a time limit to be used from the moment it is activated. Usually, the enrollment duration is 60 days, but some commercial offers may include shorter times.
The license holder can see the course contents several times within the enrollment duration.
Intellectual Property and Course Content
The material and content are the property of HURACT.
Any reproduction and distribution of the material supplied with the course are prohibited. By way of example, they are expressly prohibited the follwing.
- The use of material, methods and tools included in the HURACT courses to create and/or provide internal or external training courses;
- The sharing or distribution of materials, methods and tools included in the HURACT courses to people other than the license holder.
The downloadable material supplied with the course can be used only by the license holder. Any sharing of such material with third parties is prohibited.
All material provided with the course, including templates or documents, is provided on an "as is" and "as available" basis without any warranty or condition, express, implied or statutory.
Using Excel, Word and PowerPoint templates and examples provided requires an intermediate knowledge of Office tools. Their use is explained in the lessons of the course. No other form of assistance or help desk is provided.
Modifications to the Services and Prices
Prices are subject to change. HURACT shall not be liable to you or to any third party for any modification, price change, suspension or discontinuance of the Services.
Rules for customers-organisations (B2B)
In the case of a B2B relationship, i.e. where the HURACT customer is an organisation that purchases and distributes licenses to its members, the following points apply.
The Focal Point (FP).
The client organisation will indicate to HURACT the name of its internal Focal Point (FP). The FP will coordinate with HURACT concerning various activities explained below.
Course progress report.
At the request of the FP, HURACT communicates a CSV file containing the progress of the courses of the organisation's people on a maximum monthly frequency.
End-user support.
The FP will collect potential issues and support requests from the organisation's internal users and will HURACT for their management. HURACT does not interface with the end user but only the FP. The FP must ensure that any malfunctions are reproducible to show them to HURACT and make the diagnosis possible.
Any request for intervention that engages HURACT will be invoiced to the customer at a minimum fee of 100 CHF/hour unless this is attributable to a technical malfunction (BUG) or an error in the course content.
Extension of products and services.
The customer organisation can request other services or products complementary to the acquired licenses, for example:
- Help Desk services with service levels.
- Support and training on the use of the platform.
- Support for internal communication activities.
- Etc.
Such requests will be subject to a separate offer from HURACT.
Limitation of Liability
You expressly understand and agree that HURACT shall not be liable for any direct, indirect, incidental, special, consequential or exemplary damages, including but not limited to damages for loss of profits, goodwill, use, data or other intangible losses resulting from the use of or inability to use the service.
In no event shall HURACT or our suppliers be liable for lost profits or any special, incidental or consequential damages arising out of or in connection with our site, our services or this agreement (however arising, including negligence). You agree to indemnify and hold us and (as applicable) our parent, subsidiaries, affiliates, partners, officers, directors, agents, and employees harmless from any claim or demand, including reasonable attorneys’ fees, made by any third party due to or arising out of your breach of this agreement or the documents it incorporates by reference or your violation of any law or the rights of a third party.
Your use of the Services is at your sole risk. The Services are provided on an ”as is“ and ”as available“ basis without any warranty or condition, express, implied or statutory.
HURACT does not warrant that the Services will be uninterrupted, timely, secure, or error-free.
HURACT does not warrant that the results that may be obtained from the use of the Services will be accurate or reliable.
HURACT does not warrant that the quality of any products, Services, information, or other material purchased or obtained by you through the Services will meet your expectations or that any errors in the Services will be corrected.
In no event will HURACT’s aggregate liability for all claims of any kind, including any claims arising out of or related to this agreement, whether by statute, contract, tort, or under any other theory of liability, exceed the lesser of the fees paid by you for the services hereunder during the one (1) month period immediately preceding the date on which the cause of action arose or 100CHF.
